These terms apply to this website and to the services we provide through it. Where we have signed a separate agreement or a scope of work with you, that agreement takes precedence over these terms for that work.

These details are provided partly to meet section 43 of the Electronic Communications and Transactions Act 25 of 2002, which requires a supplier transacting electronically to identify itself.
Using this website
You may use the site for its intended purpose. You may not attempt to gain unauthorised access to it, interfere with its operation, or use automated means to extract its content at a scale that affects other users. The content of the site, other than material you upload, belongs to us.
Quotations and payment
A quotation is valid for the period stated on it and is not an offer we are obliged to hold open beyond that. Prices are in South African Rand and include VAT where VAT applies. An agreement comes into existence when you accept a quotation, in writing or through the acceptance link we send you.
Invoices are payable by the date shown. We may suspend work on overdue accounts, having told you first.
Development and systems work
What we will build is set out in the scope of work for that project. Anything not in the scope is not included, and we would rather agree a change than assume one. Changes are quoted and agreed before we do them.
Unless we agree otherwise in writing, intellectual property in work we produce for you passes to you on full payment. We retain ownership of our own pre-existing tools, libraries and components, and grant you a licence to use them as part of what we built. We may describe the work publicly and show it in our portfolio unless you ask us not to.
We do not warrant that software will be free of defects. We do warrant that we will fix defects in what we built, at our cost, for the period stated in the scope of work.
Photo book orders
You design your book in our Studio and we print it. By uploading photographs you confirm that you own them or are otherwise entitled to use them, and that you are entitled to provide any photographs of other people they contain.
We print what you approved. Please check the proof carefully — spelling, ordering, cropping and the placement of faces near a trim edge are your responsibility, because the design is yours. If we make a printing or finishing error, we reprint at our cost.
A photo book is made to your specification, which means the seven-day cooling-off right in section 44 of the Electronic Communications and Transactions Act does not apply to it, as that section itself provides. You can change or cancel an order at any time before it goes to print. Once printing has started we cannot cancel it, because the item cannot be sold to anyone else.
Delivery timescales given are estimates. We will tell you promptly if something is going to be late.
Training
Course fees are payable before the course begins unless we have agreed otherwise in writing. A place is confirmed when we confirm it, not when a booking is made.
If you cancel more than ten working days before a course starts, we refund in full. Inside ten working days we may retain the fee, but you may send a substitute delegate at no charge. If we cancel a course we refund in full, and we will tell you as early as we can.
Certificates say exactly what they are. A certificate of attendance records that you attended. A certificate for a preparation course records that you completed preparation training and is not the vendor's own certification. Where we are authorised by a certification body, our certificate says so and names them. We do not issue a certificate for a course that was not completed.
Course materials are licensed to you for your own learning and may not be copied or redistributed. Where materials belong to a certification body, that body's terms apply as well as ours.
Hosting, support and maintenance
Where we host or maintain something for you, the service, the response times and the fee are set out in the relevant agreement. We rely on third-party infrastructure and cannot guarantee uninterrupted availability. We will not delete your data without telling you, and if our arrangement ends we will provide you with a copy of it.
Your responsibilities
Work slows down when we are waiting. Please give us the content, access, approvals and decisions we ask for, and keep your own credentials secure. Where a delay in providing something moves a delivery date, the date moves.
Limits on our liability
We are liable for loss we cause you through our own failure to take reasonable care, up to the amount you have paid us for the work concerned in the twelve months before the claim. We are not liable for indirect or consequential loss, or for loss of profit, revenue or data, except where the law does not permit us to exclude it.
Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 where that Act applies to you.
If something goes wrong
Tell us. Most problems are quicker to solve than to argue about, and we would rather hear about one early. Write to info@beplugged.co.za setting out what happened and what you would like us to do, and we will respond.
If we cannot resolve it between us, we will attempt mediation before either of us goes to court. These terms are governed by South African law and the South African courts have jurisdiction.
Changes to these terms
We may change these terms. The version published here when you place an order or accept a quotation is the version that applies to it.
